Effect of This Document
The provisions of this agreement are drawn to the attention of the Workshop Participant/Guardian. Where the Consumer Protection Act 68 of 2008 applies to the relationship between Azure Dreams Enterprise Pty (Ltd) and the Participant/Guardian, the effect of this agreement is that the Participant/Guardian may have limited or no recourse against Azure Dreams Enterprise Pty (Ltd) in the circumstances set out below.
Waiver & Indemnity
I acknowledge that I am choosing to participate in the swim workshop offered by Azure Dreams Enterprise Pty (Ltd) of my own free will.I indemnify Azure Dreams Enterprise Pty (Ltd), its members, directors, employees and agents against any and all claims, losses, damages, demands, actions or causes of action arising directly or indirectly from my participation in the workshop, whether suffered by me or by any third party. I agree to hold Azure Dreams Enterprise Pty (Ltd) harmless in this regard.I understand that swim workshops may involve inherent risks, including the potential for property damage, injury or serious physical harm. I accept that Azure Dreams Enterprise Pty (Ltd) and its officers, employees and agents are not responsible or liable for any injuries, property damage or losses arising from my participation.I assume full responsibility for my decision to participate and for any consequences that may arise from such participation.I hereby release, indemnify and hold Azure Dreams Enterprise Pty (Ltd), its officers, employees and agents free from any and all losses, damages (direct, indirect or consequential), expenses, claims, suits or liabilities of any kind, including attorney’s fees, that may arise out of or be connected in any way to my participation in the workshop.
Minors
Where the Workshop Participant is a minor (under 18 years), the Participant confirms that a parent or legal guardian has assisted in completing this agreement and has consented to the minor’s participation in the swim workshop.
I, the parent/guardian, understand that swim workshops may involve inherent risks, including the possibility of injury or property damage. I acknowledge that Azure Dreams Enterprise Pty (Ltd) and its officers, employees and agents are not responsible or liable for any such injuries, damages or losses arising from the minor’s participation.
I accept full responsibility for the decision to allow the minor to take part in the workshop.
I understand that a parent/guardian must accompany the minor to the workshop and remain present for the duration of the workshop. If I am unable to attend, another responsible adult must accompany and supervise the minor.
I release, indemnify and hold Azure Dreams Enterprise Pty (Ltd), its officers, employees and agents harmless from all claims, damages, liabilities, costs or actions of any kind arising from or connected to the minor’s participation.
General
I agree that this agreement may be used as a defence in any legal action brought against Azure Dreams Enterprise Pty (Ltd), its officers, employees or agents for injuries or damages arising from participation in the workshop.
I confirm that I have read and understood this agreement, that I fully appreciate the risks involved in the swim workshop, and that I voluntarily accept such risks.
I consent to Azure Dreams Enterprise Pty (Ltd), its employees, agents and approved third-party service providers lawfully collecting, processing and storing my personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPI).
I agree that this agreement may be signed electronically in terms of the Electronic Communications and Transactions Act 25 of 2002 (ECTA), and that an electronic version of this document carries the same legal effect as a physical signed copy.
